This is because in the process, the 60-year-old man who attempted to have anal sex with him after kissing him in the neck, died after he pushed him off of him. George Kunda is alleged to have pushed Daniel Chileshe to the ground after he indecently assaulted him.
Kunda told the Ndola High Court as it passed a 15-year-jail term for manslaughter that Mr Chileshe, the now deceased lured him to a secluded place where he tried to kiss him and have sex with him before he pushed him to the ground.
In this case, Kunda , a bricklayer was charged with murder, but the charge was reduced to manslaughter after he pleaded guilty to the charge.
According to court records, Kunda was on July 4th, 2020 was called by Mr Chileshe to join him for a drink.
It was head that while in the car, Mr Chileshe, the now deceased asked Kunda which beer he was taking and then proceeded to buy him two bottles of castle lite.
Afterwards, the two drove to the Kafubu river under bridge where Mr Chileshe, the now deceased allegedly asked to touch Kunda’s nipples.
While there, it is alleged that Mr Chileshe came out of the vehicle and started kissing Kunda’s neck and then asked him if they could have sex.
Kunda then refused, pushed Mr Chileshe to the ground and drove off with his vehicle.
Kunda is alleged to have then caused an accident after he drove into a Zesco pole in Twapia township.
In mitigation, Kunda asked the court for leniency stating that being imprisoned was a horror and that he regretted his actions.
And when the matter came up before Ndola High Court judge Daniel Musonda, Kunda pleaded guilty to the reduced charge, from murder to manslaughter and aggravated robbery.
Passing judgement, Mr Justice Daniel Musonda heard the mitigation.
He said he noticed that Kunda was indecently assaulted and his response was to push the victim , causing him injuries.
“I will deal with you leniently and in count one I will sentence you to six years imprisonment with hard labour while in count two I sentence you to a minimum sentence of 15 years. The sentences will run concurrently. Meaning you will serve 15 years,” he said.
